The EEO complaint process is the exclusive forum for federal employees to address complaints of discrimination or harassment because of their race, color, religion, gender, national origin, age (40 or older), disability, or pregnancy. Federal employees may also file EEO complaints if they have been retaliated against for filing a previous EEO complaint or for complaining to management about unlawful discrimination or harassment.

Federal EEO complaints must be initiated within 45 days of the challenged action. The EEO complaint process consists of several stages, including informal counseling, alternative dispute resolution (ADR), formal written complaint, investigation, report of investigation (ROI), election of hearing before administrative judge or final agency decision, scheduling order, discovery, motions, pre-hearing, hearing and appeals.
